Acht
Jahre nach dem Völkermord in Ruanda versucht das
zentralafrikanische Land mit einem einzigartigen
Experiment über Zehntausende Beschuldigte zu
richten. Am Dienstag eröffnete Präsident Paul
Kagame die so genannten Gacaca-Gerichte. Mit
diesem vorkolonialen Rechtssystem, das
ursprünglich zur Schlichtung von
Familienstreitigkeiten oder Viehdiebstählen
diente, sollen etwa 115000 Verdächtige von
Dorfrichtern verurteilt oder freigesprochen
werden.

Rwandans
seek genocide justice through 'Gacaca', a
traditional justice system, that began in all 12
provinces in the country. Gacaca, pronounced
'Gachacha', is modeled on a traditional justice
system where people gather at the invitation of
village elders to resolve disputes within the
community.
With only one court sitting in each province,
Rwandans are expected to turn up to listen to
confessions and testimony from suspects and
survivors of the 1994 genocide. The courts will
be presided over by a panel of judges elected by
Rwandans in October last year. The more than
260,000 judges were elected based on their
integrity and moral standing in society. Each
Gacaca provincial court comprises 19 judges.

got to the ones next to me and I fainted in
fright. When I came to I started crying - I was
under the bodies of the others. A nun came to see
who was crying and she took me and the other boy
who was still alive." Romain says he thinks
gacaca is a good thing. "The killers will
come and confess, and if they ask for a pardon
they'll be pardoned."

kommen und werden gestehen, und wenn sie um
Verzeihung bitten, wird sie ihnen gewährt." |

AMNESTY
INTERNATIONAL:
The Rwandan government must ensure that
international standards of a fair trial were
guaranteed, including the presumption of
innocence and the right to prepare a defence. It
would also have to ensure that Gacaca defendants
have the right to appeal to the formal court
system; provide protection to magistrates;
defendants and witnesses; and promptly
investigate any allegations of intimidation. It
should also open investigations into human rights
violations committed by its own forces before and
since coming into power.
